Please read these terms carefully before using Choose Coffee. By using our service, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using Choose Coffee ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. You must be at least 13 years old to use this Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

2. Definitions

The following definitions apply throughout these Terms:

• "Service" refers to the Choose Coffee website, platform, and all related features and functionality.
• "User" or "you" refers to any individual who accesses or uses the Service, whether or not they have created an Account.
• "Account" refers to a registered user account created through our authentication provider.
• "Roaster" refers to third-party coffee roasters and sellers whose products are aggregated and displayed on the Service.
• "Content" refers to product information, prices, descriptions, images, reviews, recommendations, and other information displayed on the Service.

3. Nature of Service

Choose Coffee is a coffee discovery and price aggregation platform. We provide a searchable index of coffee products available from various third-party Roasters around the world.

• Aggregation Only: We do not sell coffee directly. All purchases are made through the respective Roaster's website. We are not a party to any transaction between you and a Roaster.
• Information Accuracy: While we strive to provide accurate and up-to-date information, prices, availability, and product details are subject to change without notice by the original Roaster. We are not responsible for inaccuracies in the aggregated data.
• No Endorsement: The general inclusion of any Roaster or product in our index does not constitute an endorsement or recommendation by Choose Coffee. However, products or Roasters explicitly featured in editorial selections (such as "Editor's Picks" or similar curated lists) represent our recommendations based on stated criteria.

4. User Accounts

To access certain features of the Service, you may need to create an Account. When you create an Account:

• Accurate Information: You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete.
• Account Security: You are responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account. You agree to notify us immediately of any unauthorized use of your Account.
• One Account: You may not create multiple Accounts or share your Account credentials with others.
• Administrative Access: We may review account records and related service data as reasonably necessary to provide support, investigate abuse, comply with law, or protect the Service.

5. User-Generated Content

The Service allows registered Users to post reviews, ratings, tasting notes, and other content ("User Content"). By submitting User Content, you agree to the following:

• Content License: By posting User Content, you grant Choose Coffee a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable license to use, display, reproduce, and distribute your User Content on the Service. This license exists solely for the purpose of operating and improving the Service.
• Content Responsibility: You are solely responsible for the accuracy, legality, and appropriateness of any User Content you submit. You represent that your User Content does not infringe any third-party rights and complies with all applicable laws. You should not include any personal or sensitive information in your reviews or tasting notes that you do not wish to be publicly visible.
• Content Moderation: Choose Coffee reserves the right, but is not obligated, to review, edit, or remove any User Content at our sole discretion. We may remove content that violates these Terms, is spam, is offensive, is misleading, or is otherwise objectionable.
• Public Display Consent: When you post a review or rating marked as public, you consent to your name and profile picture being displayed alongside your User Content and visible to all visitors of the Service. You can control whether an individual review is public when you create or edit it.
• Content Removal: You may delete your own User Content at any time. If you delete your Account, all associated User Content will be removed from public display. Choose Coffee may retain anonymized or aggregated data derived from User Content (such as aggregate ratings) after deletion.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Use automated scripts, bots, or other means to scrape, harvest, or collect data from the Service without our express written permission
• Attempt to circumvent, disable, or interfere with security features of the Service
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
• Transmit any viruses, malware, or other malicious code
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Use the Service for any commercial purpose not expressly permitted by these Terms

We reserve the right to suspend or terminate your access to the Service for any violation of these Terms.

7. Intellectual Property

Our Platform: The design, code, features, and overall presentation of Choose Coffee are the property of Choose Coffee. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

Third-Party Marks: All Roaster names, logos, and product names remain the property of their respective owners. Their use on our Service is for identification and informational purposes only.

Product Descriptions: Product descriptions displayed on the Service may be sourced from publicly available information on Roaster websites. All Roaster names, logos, product names, and associated descriptions remain the property of their respective owners. Roasters may request removal of their content at any time via our opt-out policy below.

8. Third-Party Sites & Roaster Relationships

The Service contains links to third-party websites operated by Roasters. We are not responsible for the content, products, or practices of any third-party websites.

• Independent Transactions: Any purchases you make from Roasters are solely between you and the Roaster. Choose Coffee is not responsible for the quality, safety, legality, or delivery of products purchased from Roasters.
• Roaster Terms: You should review the terms of service and privacy policies of any Roaster before making a purchase.
• No Liability: Choose Coffee disclaims all liability for any harm or damages arising from your interactions with Roasters or other third parties.

Roaster Opt-Out Policy

We aim to drive traffic and customers to coffee Roasters. However, we respect the wishes of any business owner regarding their data:

• Removal Request: If you are a Roaster and wish for your products to be removed from our index, please contact us. We will honor removal requests promptly.
• Technical Compliance: Our team reviews robots.txt and related public policies when evaluating whether to include a Roaster in our index and periodically thereafter, and our data-collection workflows include rate-limiting delays intended to reduce load on Roaster websites.

9. Disclaimer of Warranties

"As Is" Basis: The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, Choose Coffee disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

No Guarantee: We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any Content on the Service.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Choose Coffee shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, arising out of or relating to your use of or inability to use the Service.

In no event shall Choose Coffee's total liability to you for all claims arising out of or relating to these Terms or your use of the Service exceed the greater of (a) the amount you paid to Choose Coffee in the twelve months prior to the claim, or (b) one hundred U.S. dollars ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless Choose Coffee and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use or misuse of the Service
• Your violation of any rights of a third party
• Any content you submit, post, or transmit through the Service

12. Termination

By You: You may terminate your Account at any time by contacting us or using the account deletion feature if available.

By Us: We may suspend or terminate your Account or access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, suspected fraudulent or illegal activity, or extended periods of inactivity.

Effect of Termination: Upon termination, your right to use the Service will immediately cease. We may delete your Account data in accordance with our Privacy Policy. Sections 7, 9, 10, 11, 13, and 15 of these Terms shall survive any termination.

13. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.

Informal Resolution: Before filing any legal claim, you agree to first contact us and attempt to resolve the dispute informally by sending a written notice to legal@choose.coffee. We will attempt to resolve the dispute within 30 days.

Jurisdiction: If informal resolution is unsuccessful, any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in King County, Washington, and you consent to the personal jurisdiction of such courts.

14. Changes to Terms

We may modify these Terms from time to time. When we make material changes, we will:

• Post the updated Terms on this page with a new "Last updated" date
• Update our internal terms version so signed-in users can be prompted to review and accept the current Terms
• Provide additional notice in the product or by email when we consider it appropriate for the nature of the change

Changes will not apply retroactively. By continuing to use the Service after updated Terms take effect, you agree to the revised Terms. If you do not agree to the modified Terms, you should discontinue your use of the Service.

15. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Choose Coffee regarding your use of the Service.

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms shall not be considered a waiver of such right or provision.

Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Choose Coffee may assign its rights and obligations without restriction.
